Muslim Married Women And Their Well-Wishers To Get Relieved From Triple Talaq

The Muslim women and their family members will breathe a sigh of relief with the introduction of the bill on Triple Talaq in the Parliament of India on Thursday seeking to provide justice for the innocence. In Lok Sabha, the instant “Triple Talaq” practice will be criminalized among the Muslim. Ravi Shankar Prasad the law minister has listed to induce the bill under the Protection of Rights on Marriage for Muslim women on December 28, 2017, in the Lok Sabha.

Rajnath Singh the Home Minister and also the head of inter-ministerial group has drafted the bill while making the Talaq-e-Biddat or Triple Talaq gave in writing or said in any form or by means of electronic such as social platforms, email, WhatsApp, SMS will be considered as void and illegal will charge for a 3 year jail punishment for the husband.

Earlier this month, the Union Cabinet of India gave approval on the bill on Triple Talaq. Although the sources mention that the introduction of the bill was set for last week but due to parliamentary matter later Ananth Kumar states the introduction of the bill to be extended to introduce in this week.

As per the provision, every act or punishment has a jail punishment along with a fine or penalty. Similarly, the bill states that there will be fine for the husband to pay while the amount of the penalty would be set by the Magistrate of India after the hearing of the case. Even after the SC (Supreme Court) banned the “Talaq-e-Biddat”, it still continues to be practiced while urging for the introduction of the bill on the practice. The said law will be only valid on immediate “Triple Talaq” cases while empowering the woman and her minor children for “Subsistence Allowance” from her husband after seeking the approval from the magistrate. The woman has the right to further extend her powers to get the guardianship of her juvenile children after the hearing of the case by the magistrate.
